94 HJY DREAM MACHINE CONTEST

OFFICIAL RULES

 

Contest Timeframe: August 16th, 2008 to Oct. 18th, 2008

 

Prize Details:

Winner receives “The WHJY Dream Machine” package:

A CUSTOM BUILT FACTORY FIVE ROADSTER

Vehicle is given away in “as is” condition.  Vehicle available for inspection at various WHJY promotional events during contest timeframe.

 

Eligibility:

Contestants must be at least 18 years of age or older and a U.S. licensed driver on or before registering to win. All employees of WHJY, Clear Channel Worldwide, Carl’s Collision Center, Twin River Casino, and their immediate families (The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws,” or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related.) are not eligible to participate. 

Limit one (1) entry per person, per radio station appearance.

 

Qualification:

All eligible persons may register to win at various WHJY promotional events, announced on the air. A random drawing will take place at conclusion of the contest on August 8, 2008.  One entry per person will be accepted, meaning one entry at each station event the vehicle appears.  All duplicate entries will be discarded. 

 

Contest Methodology:

Beginning Aug. 16th, 2008 and continuing through Oct. 25th, 2008, a maximum of 94 finalists will be drawn at:

 

1)      Various WHJY promotional events throughout the summer, promoted on WHJY as “Dream Machine Key Drops” 3-5 days prior to each event.  These events run 94 minutes to 2 hours).  At the conclusion of these events, a minimum of one (1) finalist key will be drawn and winners will be notified by phone, followed with a confirmation letter via mail.  Key finalists do not need to be present at conclusion of events to win their key, unless stated otherwise at start of event.  If name drawn is ruled ineligible, another name will be drawn in place of the ineligible name.

 

2)      A minimum of twelve (12) Key Finalists will be drawn from all eligible official Dream Machine entry forms received from registration locations (Twin River, www.whjy.com.)

3)      A minimum of four (4) Finalist Keys will be drawn at The 94 HJY Dream Machine Giveaway Party on Saturday, Oct. 25th, 2008, at Twin River Casino in Lincoln, RI.  These final Keys will be drawn by 7pm and winners need to be present to compete in the Dream Machine giveaway. 

4)     A minimum of ten (10) Finalist Keys will be given away on air on WHJY throughout the summer.

 

MuthaLoad Giveaway:

On Saturday, Oct. 25th, 2008, all Key Finalists must be present at the Dream Machine Give-away event at Twin River Casino, Lincoln, RI no later than 7pm.  Key Finalists must check in with valid driver’s license at WHJY registration booth no later than 7pm.  There will be no proxy representation unless previously arranged by WHJY Promotions Department.  In such case, proxy will sign a statement stipulating that they are the acting solely on behalf of Finalist Key winner and any prizes won will go to actual winner, not proxy.  Contestants will check in and be given instructions as to the actual contest that will award the Dream Machine prize. This contest will take place at approximately 7:30pm.  Roll call begins where each finalist’s name is read aloud to be sure they are present to start the actual contest.  All finalists will stand in a large circle and be handed their official “Oil Can”.                                                                                                                                                                                                                                                                     

All qualifiers will receive the same item (Oil Can), three (3) of these oil cans will contain potential keys to the Dream Machine, while ninety-one (91) will have a “consolation item” that designates them as a “loser”.  All finalists will crack open their “Oil can” simultaneously.  The three (3) Finalists who get the actual keys will then move forward into the winner’s circle to try their keys in the Dream Machine.  The other finalists who have lost will receive consolation prizes from WHJY.  The three finalists in the Winner’s Circle will draw straws to designate whom goes first, second and third at trying to start the vehicle.  The first finalist who tries their key in the ignition of the dream machine and starts up the engine is the winner!  The contest is over at this point.  If there should be a mechanical malfunction and none of the three keys unlock the ignition, all three keys will be examined and the person found to be holding the will be determined the winner.  Winner wins the Factory 5 roadster.

 

Winner Release:

 

The 94 HJY Dream Machine winner will be responsible for any and all applicable taxes, title, registration fees, license and insurance costs associated with the prize.  Total value of prize has been determined as Minimum value of $60,000.  Final paperwork and transfer of ownership will be arranged through WHJY, Bald Hill Dodge, Boat World and Precision Harley Davidson the week of August 30, 1999.

 

 

WHJY reserves the right to change contest methodology at any time during the promotion.  Decision of WHJY Promotions Department is final.

ON-LINE CONTEST RULES

 

 

Contest Name: “CHARLES IN VEGAS TRIP” Giveaway (the “Contest”)

 

Contest Dates:  Beginning Aug. 11, 2008 and ending September 6, 2008.

                                                                                                               

Clear Channel Online Music & Radio, its subsidiaries and affiliated companies ("Company"), will conduct the Contest substantially as described in these rules, and by participating, each participant agrees as follows:

The Company will conduct this multi-market Contest accessible from several participating radio station websites licensed to or managed by the Company and in various States.

1. Description of Contest/Participation. When the cue to call is announced…caller 9 qualifies…must be over 18…passport to except prize by date of departure…winner drawn at random at Tasca Ford in Cranston on Sept. 6th, 2008.

The trip includes …air fare…4 nights’ hotel accommodations in Las Vegas…and transfers.

The winner and guest must be over 18.

 

A. Dates of Contest: The Contest will be conducted beginning 8:00 a.m. EST on Aug. 11, 2008, and ending around 5:00 p.m. Sept. 6th, 2008.            

B. How to Enter:

 

NO PURCHASE IS NECESSARY.  PURCHASE DOES NOT INCREASE ODDS OF WINNING.  Odds of winning vary greatly depending on number of entrants. Void where prohibited.  Register by listening 94HJY from 6am to 12am during the dates of contest. One entry per person per household. Valid contest entries must contain all information requested. Incomplete entries will be disqualified. 

 

C. How To Play: Winner(s) will be randomly selected from all entries received by the registration deadline (Sept. 6th). Winners will be notified by e-mail or phone. If a winner cannot be contacted within 48 hours from the information provided to the DJ, the Company reserves the right to select another winner in its sole discretion.

 

2. Prize(s).

The prize(s) that may be awarded to the eligible winner(s) is either:

 

A) HJY/Charles/Tasca racing T-Shirt

 

Runner-Up Prizes are non-transferable, not redeemable for cash and not exchangeable for any other prize. All prizes must be redeemed within 30 days after the winner has been notified that he or she has won a prize in the contest, including signed copies of release and tax forms when required. If a winner is disqualified, the Company reserves the right to determine an alternate winner or not to award that winner’s prize, in its sole discretion.

 

B. One (1) Grand Prize: On Sept. 6, 2008, one Grand Prize Winner will be randomly selected from all qualified entries received.  Grand Prize winner will receive the Grand Prize listed below:

 

Trip is from Oct 30th to Nov. 2nd and includes: roundtrip airfare for two from Prov to Vegas.  Hotel will be Golden Nugget, Orleans, Stratosphere properties.  It will require the traveler to pay hotel and air taxes.

The winner and guest must be over 18.(retail value $2,000)

 

Grand prize is non-transferable, not redeemable for cash and not exchangeable for any other prize. All prizes must be redeemed within 7 days after the winner has been notified that he or she has won a prize in the contest, including signed copies of release and tax forms when required. If a winner is disqualified, the Company reserves the right to determine an alternate winner or not to award that winner’s prize, in its sole discretion.

Accommodation and travel plans must be made with a Company designated travel agent. Winner is responsible for all taxes and fees.

 

For giveaways involving travel, the prize value may vary depending upon departure location and time of travel.  Black out dates and other restrictions may apply. Hotels may be changed and are subject to availability. 

 

Grand Prize is non-transferable, is redeemable for cash and not exchangeable for any other prize. All signed copies of release and tax forms must be completed within 30 days after winner notification. If a winner is disqualified, the Company reserves the right to determine an alternate winner or not to award that winner’s prize, in its sole discretion.

 

3. Eligibility and Limitations.

Participants, winner(s) and guests, if applicable, must be legal U.S. residents at least 18-years old as determined by the Company and reside within 75 miles of the Station's Total Survey Area (TSA) as defined by Arbitron Inc., a radio research firm. Winner assumes all liability for use of the prize. Only one (1) entry per person per week. Employees of the Company, the Prize Provider and their advertising agencies, employees of other radio stations, and members of the immediate family of any such persons are not eligible to participate and win. The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws,” or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related.

 

4. Telephone and Delivery Disclaimer.

Participants are restricted to use of ordinary and typical computer equipment and Internet access. The Company disclaims all liability for the inability of a participant to complete or continue an entry due to equipment malfunction, busy lines, inadvertent disconnections, acts beyond the Company’s control, or otherwise. The Company disclaims any liability for entries that are not received due to technical difficulties or transmission errors. The Company disclaims all liability for any delays, misdelivery, loss, or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery method. The Company is not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including: failed, incomplete, garbled or delayed transmission of online entries, traffic congestion on telephone lines, the Internet or at any website or lost or unavailable network connections which may limit an online entrant's ability to participate in the Contest, and any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in or downloading any information necessary to participate in the Contest.

 

5. Publicity.

By participating, where allowed by law, all participants and winner(s) grant the Company exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this and other contests and waive any claims to royalty, right, or remuneration for such use.  By participating, where allowed by law, participants agree that the Company may disclose personal information obtained from participants in the Contest to third parties and use such information for marketing and other purposes. 

 

6. Release.

By participating, each participant and winner waives any and all claims of liability against the Company, its employees and agents, the Contest’s sponsors and their respective employees and agents and the Prize Provider and its respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Contest, or from the use of any prize. In order to receive a prize, participants must sign an official waiver form provided by the Company.

 

7. Taxes.

Any valuation of the prize(s) stated above is based on available information provided to the Company, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Each winner is solely responsible for reporting and paying any and all applicable taxes and paying any expenses associated with any prize(s) which are not specifically provided for in the official rules. Each winner must provide the Company with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded.  Prizes are not transferable or exchangeable for any other prize.  Any person winning over $600 in prizes from the Company will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.

 

8. Conduct and Decisions

By participating in the Contest, participants agree to be bound by the decisions of Company personnel.  Persons who violate any rule, gain unfair advantage in participating in the Contest, or obtain winner status using fraudulent means will be disqualified.  Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited.  The Company will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest and the Company's decisions concerning such disputes shall be final.  If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Company, the Company reserves the right to terminate this Contest, or make such other decisions regarding the outcome as the Company deems appropriate.  All decisions will be made by the Company and are final.  The Company may waive any of these rules in its sole discretion.  ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS CONTEST, TELEPHONE SYSTEMS OR WEBSITE, OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, COMPANY RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.

 

9. Miscellaneous.

Each winner must submit proof of eligibility and sign the Company’s release form to claim the prize. No purchase necessary to participate or win.  Purchase does not increase chance of winning.  Void where prohibited.  Odds of winning depend upon the number of participants.  The Company may substitute prizes, amend the rules or discontinue the Contest at any time as posted on the website. The Company disclaims any responsibility to notify participants of any aspect related to the conduct of the Contest. For a copy of the rules, or where required by law, a list of winners, please send your request within 30 days of the end of the giveaway by mail with a stamped, self-addressed return envelope with contest name and addressed to: Clear Channel Providence, 75 oxford st. Providence Rhode Island, 02860. All entries become the property of the Company and will not be returned.

 

10. Compliance with Law.

The conduct of the Contest is governed by the applicable laws of the United States of America, which take precedence over any rule to the contrary herein. Station(s) shall follow the applicable laws for conducting contests, including notice to the state attorney general or consumer affairs office, posting of a prize bond, furnishing lists of winners, running specific on-air disclaimers, providing specific written information about the Contest, etc. as required by local and state law.
